In simple terms, Section 180 allows qualifying landowners to deduct the value of residual soil nutrients already present in the ground at the time they acquire the property.

For many Texas operations, that deduction can be substantial, commonly in the range of $500 to $2,000 per acre, especially if the land was purchased in the last 20 years. Even for lands purchased or inherited before then, while the deduction may not be as high per acre, it should still be investigated. The key concept is excess or residual fertility, nutrient levels above a normal baseline that a typical crop or forage would use in a single year. Phosphorus, potassium, lime, and a number of micronutrients are the primary focus. Nitrogen often doesn't add much if any value because it does not remain in the soil in the same way. This is not a credit. It is a deduction that reduces taxable income. The size of the deduction depends entirely on what the soil tests show and how those nutrients are valued using regional pricing at the time of purchase.

Who Qualifies for Section 180?
Eligibility rests on a few clear requirements:
You must be engaged in the business of farming or agriculture of some type. This includes the production of crops or the sustenance of livestock. Pasture and ranchland qualify, including exotic wildlife ranching operations; land used solely for native wildlife habitat does not.
The land must have been acquired by purchase or inheritance.
Soil testing must document residual nutrients above baseline levels.
The deduction is claimed for the tax year of acquisition (including extensions). Your CPA could use Form 3115 to take this deduction if you purchased your land in prior years, or file an amended return.
Cash-rent landlords who do not materially participate generally cannot use Section 180; however, other IRS sections may apply. Please consult your CPA. Crop-share arrangements and active operators are in a stronger position. Inherited land can qualify in many cases, though the details should be reviewed carefully with a CPA.

Clear separation of residual (excess) fertility from baseline levels
